NTX-POWER – Terms & Conditions
These Terms & Conditions (“Terms”) govern all sales, installations, services, maintenance agreements, and any other work performed by NTX-Power (“Company,” “we,” “our,” or “us”). By purchasing products or services from NTX-Power, the customer (“Client,” “you,” or “your”) agrees to these Terms.
1. Products & Services
NTX-Power provides:
All products, brand names, and specifications are subject to availability.
2. Quotes & Pricing
2.1 Quotes
All quotes are valid for 30 days unless otherwise noted. Pricing may change due to manufacturer price adjustments or unforeseen circumstances.
2.2 Deposits
A deposit may be required to schedule installation or secure equipment.
2.3 Payment Terms
Payment is due according to the payment schedule on the invoice. NTX-Power accepts cash, card, check, and approved financing options.
2.4 Financing
Financing through Synchrony Bank is subject solely to Synchrony’s terms, credit approval, and conditions. NTX-Power is not responsible for financing decisions or loan terms.
3. Installation Terms
3.1 Site Requirements
Client must ensure the installation area is accessible, code-compliant, and clear of hazards or obstructions.
3.2 Permits & Inspections
NTX-Power will assist in obtaining required permits; however, final approval by governing authorities is outside our control.
3.3 Utility Coordination
Client is responsible for any charges, delays, or requirements from gas and electric utilities. NTX-Power cannot control utility timelines.
3.4 Unforeseen Issues
If unexpected site conditions arise (rocks, roots, electrical issues, plumbing conflicts, code violations, etc.), additional charges may apply.
3.5 Weather Delays
Installations may be rescheduled if weather conditions prevent safe or proper work.
4. Generator Operation & Warranty
4.1 Manufacturer’s Warranty
All new generators come with the manufacturer’s warranty. NTX-Power honors and assists with warranty claims but does not control manufacturer decisions.
4.2 NTX-Power Workmanship Warranty
We guarantee installation workmanship for 1 year unless otherwise specified.
4.3 Warranty Limitations
Warranty does not cover:

5.1 Customer Responsibilities
Client must follow recommended maintenance schedules to maintain manufacturer warranty coverage.
5.2 Service Plan Terms
Service plans cover routine inspections and maintenance but do not guarantee repair priority, parts availability, or emergency service unless specifically listed.
5.3 Emergency Calls
After-hours or emergency visits may incur additional fees.

NTX-Power is not liable for:

8. Scheduling & Cancellations
8.1 Rescheduling
Appointments may be rescheduled with 48-hour notice.
8.2 Cancellations
Cancellation of contracted installation may result in restocking fees or forfeiture of deposits for special-order equipment.
9. Property Damage Disclaimer
NTX-Power will take reasonable precautions while working, but minor cosmetic disturbances (lawn markings, soil movement, landscaping disturbances, etc.) may occur during installation. Client acknowledges these are common and not covered under warranty.
10. Equipment Ownership
Ownership of equipment transfers upon final payment. NTX-Power may remove installed equipment if payment is not completed.
11. Privacy & Communications
Client agrees NTX-Power may contact them via phone, SMS, or email regarding service reminders, invoices, installation updates, and promotions.
12. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes will be handled in the county of NTX-Power’s primary business location.
13. Acceptance of Terms
By purchasing products, scheduling service, or signing an estimate/invoice, the Client acknowledges and accepts these Terms & Conditions.
